General Data Protection Regulation

While link-tundra operates primarily in Canada, we recognize the importance of protecting the privacy rights of all website visitors, including those in the European Union. This page outlines our commitment to GDPR principles and how we handle data for EU residents.

Lawful Basis for Processing

When we collect and process your personal data, we rely on the following lawful bases under GDPR:

  • Consent: You provide explicit consent when submitting booking forms or contact requests
  • Contractual Necessity: Processing is necessary to fulfill expedition booking agreements
  • Legitimate Interests: We process certain data to improve our services and maintain operational records, balanced against your privacy rights
  • Legal Obligation: Certain data retention is required by Canadian business and liability laws

Your GDPR Rights

If you are an EU resident, you have specific rights regarding your personal data:

Right to Access

You can request confirmation of whether we process your personal data and obtain a copy of that data in a commonly used electronic format.

Right to Rectification

You can request correction of inaccurate personal data or completion of incomplete data we hold about you.

Right to Erasure

You can request deletion of your personal data in certain circumstances, including when the data is no longer necessary for its original purpose or when you withdraw consent. This right is subject to our legal obligations to retain certain business records.

Right to Restriction of Processing

You can request that we limit how we use your personal data in specific situations, such as while we verify data accuracy following a correction request.

Right to Data Portability

You can request transfer of your personal data to another service provider in a structured, machine-readable format where technically feasible.

Right to Object

You can object to processing of your personal data based on legitimate interests. We will cease such processing unless we demonstrate compelling legitimate grounds that override your interests.

Right to Withdraw Consent

Where processing is based on your consent, you can withdraw that consent at any time. This does not affect the lawfulness of processing before withdrawal.

Right to Lodge a Complaint

You have the right to lodge a complaint with your local supervisory authority if you believe our processing of your personal data violates GDPR.

How to Exercise Your Rights

To exercise any of these rights, send a detailed request to [email protected]. Please include:

  • Your full name and contact information
  • Specific right you wish to exercise
  • Relevant details to help us locate your information (such as booking dates or previous communications)

We will respond to your request within 30 days. In complex cases, we may extend this period by an additional 60 days and will notify you of any extension.

Data Controller

For the purposes of GDPR, the data controller is:

International Data Transfers

Your personal data is processed and stored in Canada, which is recognized by the European Commission as providing adequate protection for personal data under the GDPR adequacy decision.

We do not transfer personal data to countries outside Canada and the EU except where necessary for expedition logistics (such as obtaining permits from government authorities). Any such transfers comply with GDPR requirements for international data transfers.

Automated Decision-Making

We do not use automated decision-making or profiling that produces legal effects or similarly significant effects on individuals. All booking decisions and customer communications involve human review.

Data Retention

We retain personal data only for as long as necessary to fulfill the purposes for which it was collected:

  • Booking and trip participant data: Seven years from trip completion (required for liability and business record purposes)
  • Contact inquiries that do not result in bookings: Two years from last communication
  • Cookie consent preferences: Until withdrawn or browser cache cleared

Following these retention periods, personal data is securely deleted or anonymized.

Third-Party Processors

We work with limited third-party service providers who may process personal data on our behalf, including:

  • Website hosting providers
  • Email service providers

All third-party processors are bound by data processing agreements that require GDPR-compliant handling of personal data.

Data Security

We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including:

  • Encryption of data in transit using SSL/TLS protocols
  • Access controls limiting data access to authorized personnel only
  • Regular security assessments and updates
  • Secure data backup procedures

Data Breach Notification

In the event of a data breach that is likely to result in a risk to your rights and freedoms, we will notify affected individuals within 72 hours of becoming aware of the breach, in accordance with GDPR requirements.

Changes to This Policy

We may update this GDPR compliance statement to reflect changes in our practices or legal requirements. Material changes will be communicated through website notice or direct email to individuals whose data we hold.
